Kursbeschreibung:
Jurisprudence plays a key role in international law. On the one hand, it authoritatively reflects the state of international law, and on the other, it contributes to the development of international law. Its relevance goes far beyond the wording of Article 38(1)(d) ICJ Statute. According to this provision judicial decisions are “subsidiary means for the determination of rules of law.”
The course covers the jurisprudence of the most important international courts, including
· the International Court of Justice and its predecessor, the Permanent Court of International Justice,
· the International Criminal Court and the international criminal tribunals,
· the International Tribunal for the Law of the Sea and
· regional human rights courts.
The genesis of the courts and tribunals is discussed as well as important and current decisions.
The case law of national courts relating to international law and the impact of these decisions on international law will also be discussed.
Students are required to prepare the court decisions to be discussed at home.
An excursion to the International Tribunal for the Law of the Sea in Hamburg is planned.
