This course provides students with a thorough introduction to the field of international economic law, focusing on the legal frameworks that govern global trade and foreign investment. It aims to equip students with the ability to analyze key legal principles and apply them to contemporary challenges in international economic relations. The course examines the institutional structures and substantive rules of the World Trade Organization (WTO) and international investment law, including dispute settlement mechanisms, national treatment, most favored nation principles, and fair and equitable treatment principles, and their interplay with national regulatory autonomy. Central questions include: How do WTO law and investment treaties shape global economic governance? To what extent do these regimes balance liberalization with non-trade and non-investment values such as environmental protection, public health, and national security? How do dispute settlement systems operate in practice, and what are their current challenges? Through engagement with treaties, case law, and current policy debates, students will develop a critical understanding of the opportunities and tensions inherent in the regulation of trade and investment in a globalized world.
