Short description
Numerous and highly diverse adjudicatory bodies carry out international adjudication. Some have a broad mandate, while others have sector-specific or regionally limited jurisdictions. Their decision-making processes and the impact of their judgements and decisions differ. Furthermore, these courts do not form a coherent, hierarchically organised system; rather, they constitute something akin to a global community of international courts, with complex heterarchical relationships between them. Yet, the development of international law was profoundly influenced by decisions rendered by international courts, tribunals, and arbitration panels. Against this background, the course will provide a concise overview of these different adjudicatory bodies, highlighting their similarities and differences, as well as their landmark cases. Together, we will also discuss some of the theoretical questions surrounding international adjudication, as well as recent trends and challenges in this area.
This course aims to equip participants with the skills needed to navigate the world of international adjudication. Participants will learn how to research, understand and evaluate case material from various international adjudicatory bodies by studying some of the seminal cases of international adjudication.
